The Building Permit Process

HENDRY building surveyors provide clients with a building permit for buildings ranging from minor works through to the construction of a multi - storey building. Some building permit applications, even for small properties, can be complicated and time consuming for a building surveyor to ensure compliance with the Building Code of Australia. To help our clients better understand the building permit process we provide the following explanation.

Building Permit: Regulatory Control System

Building Act 1993The Building Act 1993 sets out the criteria for when a building permit is required. Section 16 states:

 16. Building permit required

(1) A person must not carry out building work unless a building permit in respect of the work has been issued and is in force under this Act and the work is carried out in accordance with this Act, the building regulations and the permit.

The Building Regulations 2006 covers the requirements for a building permit in Part 3 - Building Permits. Regulation 301 requires the applicant to apply for a building permit by using a Form 1 Application For A Building Permit. An applicant should ensure that all information required by the building permit application for the type of building is provided.
